USCIS Resumes Accepting DACA Renewal Requests

This past weekend the USCIS announced that it has begun accepting requests to renew grants of Deferred Action for Childhood Arrivals (DACA). Individuals who were previously granted deferred action may now request renewals by filing the Form I-821D, Form I-765, and Form I-765 Worksheet at the designated USCIS filing location.

USCIS is not accepting requests from individuals who have never received deferred action, and it will not accept nor approve advance parole requests from DACA recipients. USCIS will accept renewal requests from DACA recipients whose status expired on or after September 5, 2016. DACA recipients whose status expired before September 5, 2016 or was previously terminated at any time may file a new initial DACA request. USCIS also stated that DACA policy will be operated on the terms in place before the policy was rescinded on September 5, 2017.

USCIS' announcement is a response to U.S. District Judge William Alsup's preliminary injunction, issued on Tuesday, January 9th, which requires safeguards against deportation to remain in place for DACA recipients while a legal challenge against the Trump Administration's decision to end the program proceeds.
