H-1B Premium Processing Suspended for FY 2019 Cap Cases

USCIS announced the suspension of premium processing for all FY 2019 cap-subject H-1B petitions on Tuesday. The suspension is expected to last until September 10, 2018. During this time, USCIS will continue to accept premium processing requests for H-1B petitions not subject to the FY 2019 cap.

USCIS will now reject any Form I-907, Request for Premium Processing Service, filed with an FY 2019 cap-subject petition. When USCIS confirms that premium processing has resumed, petitioners may then file a premium processing upgrade for any FY 2019 cap-subject petitions that remain pending. USCIS explained that this suspension will allow them to process long-pending petitions and prioritize adjudication of extension cases nearing the 240 day mark.
