Forbes Analyzes Rising H-1B Denial Rates

Today Forbes published an article entitled, "New Data Show H-1B Denial Rates Reaching Highest Levels". In this article, Forbes analyzes H-1B denial rate data from USCIS' new H-1B Employer Data Hub. Specifically, Forbes assessed data gathered by the non-partisan National Foundation for American Policy, which compiled H-1B denial data spanning from Fiscal Year 2009 through the first quarter of Fiscal Year 2019. The data show USCIS denial rates for initial H-1B petitions increased from as low as five percent in Fiscal Year 2012 to thirty-two percent for the first quarter of Fiscal Year 2019.

For the article, Forbes interviewed Goel & Anderson's Managing Partner, Vic Goel, about the effect of President Trump's "Buy American, Hire American" Executive Order. Mr. Goel explained that USCIS has used the executive order to "upend years of established practice, including rescinding long-standing policies on what occupations qualify for H-1B visas."
